The articles contained here discuss various aspects of the Ad Hoc International Tribunal for the Prosecution of Serious Violations of International Humanitarian Law in the Former Yugoslavia, which was created for the primary purpose of examining alleged war crimes committed by Serbs and their leadership against the Bosnian Muslim community.
Abstract
The introductory articles describe the precedent in international tribunals set by the Nuremberg trials following World War II and discuss the principles underlying the concept of international criminal justice. Several articles explore the political, ethical, and legal problems surrounding the establishment of the Tribunal. The substantive and procedural issues examined in these articles include the statutes and rule of the International Tribunal; legal, procedural, and evidentiary issues related to rape and other forms of sexual assault in armed conflict; rules of procedure and evidence for the Tribunal; and means of securing the presence of defendants before the Tribunal. 4 appendixes
