This report presents a chart that shows the existence and components of each State's and the District of Columbia's juvenile waiver statute.
Abstract
The information is current through March 31, 1995. Juvenile waiver statutes pertain to whether, how, and under what circumstances juveniles can be tried in an adult criminal court. The information provided for each State encompasses the code provision for the juvenile waiver statute; age restrictions specified in the statute; the crime restrictions; and whether the waiver is mandatory, discretionary, or presumptive. "Felony" as used in the chart refers to an offense that would constitute a felony if committed by an adult. The report notes that even where mandatory transfer to adult court is indicated, an adult court may have statutory authority to transfer the case to juvenile court, or there may be an exception that permits the juvenile court to retain jurisdiction. Where the adult court has original jurisdiction, as indicated on the chart by the existence of an exclusion, the likelihood of an eligible case being sent to juvenile court is substantially reduced.
