This manual sets forth procedures for both law enforcement officers and the courts to promptly and effectively respond to domestic violence cases.
Abstract
Procedures in the manual are described under the following categories: (1) Law Enforcement (domestic violence standard; domestic violence performance standards; guidelines on police response procedures in domestic violence cases, including mandatory and discretionary arrest, seizure of weapons, domestic violence complaints, emergency temporary restraining court orders, service of temporary restraining order, court order violations, criminal offenses against the elderly and disabled); (2) Initial Complaints (jurisdiction, including who can bring a domestic violence action and what behavior constitutes domestic violence; processing domestic violence complaints; withdrawals and requests for dismissal; (3) Enforcement of Domestic Violence Orders (criminal contempt; enforcement of litigant's rights proceedings); (4) Requests for Modification of Domestic Violence Orders.
