This brochure contains the text of Recommendation No. R(95)4 and Explanatory Memorandum of the Committee of Ministers of the Council of Europe to member states on the protection of personal data in the area of telecommunication services, with particular reference to telephone services.
Abstract
The Committee of Ministers, when creating this recommendation, considered a number of factors: the increasing use of automated data processing in telecommunication services; advantages to be gained from technological developments, particularly in the area of telephone services; and the move towards digitization of networks. At the same time, they recognized the possible risks to the privacy of the users and possible inhibitions on their freedom of communication from caller identification, call-forwarding, mobile telephones, call-tracing, and automatic-dialing devices. Noting that new developments in telecommunication services must respect the right to private life and secrecy of correspondence guaranteed by Article 8 of the European Convention on Human Rights, the Committee composed a Recommendation that covers: (1) respect for privacy; (2) collection and processing of data; (3) communication of data; (4) rights of access and rectification; (5) security; and (6) implementation of principles.
