This report contains citations and descriptions of the State and Federal laws that affect privacy and data collection as of 1997.
Abstract
Following a discussion of the nature and significance of privacy, this report profiles the "Privacy Journal" and presents a chart of State and Federal privacy laws. This is followed by the main body of the report, which presents citations for State and Federal laws that are listed under various topical categories. These categories include arrest and conviction records, bank records, cable television, computer crime, credit reporting and investigation, criminal justice information systems, electronic surveillance, employment records, government information on individuals, and insurance records. Other categories are library records, mailing lists, medical records, polygraphing in employment, privacy statutes/State constitutions, privileged communications, school records, social security numbers, tax records, telephone services, and testing in employment. Each statute is cited by title, article, chapter, paragraph, and/or section, so it can be found in a statute book, generally a revised or annotated version. The appendix contains printed texts of representative statutes, including the Federal Fair Credit Reporting Act, the Federal law on electronic surveillance, the Federal Driver's Privacy Protection Act, the Federal Family Educational Rights and Privacy Act, and the New Jersey Genetic Privacy Act. Canadian privacy laws are also cited in the appendix.
