Abstract

Chapter 85 of Title 11 of the Delaware Code pertains to the establishment and duties of the State Bureau of Identification. The purpose of this chapter is to create and maintain an accurate and efficient criminal justice information system in the State consistent with applicable State and Federal law and regulations. It further aims to meet the need of Delaware criminal justice agencies and courts for accurate and current criminal history record information while protecting the right of individuals to be free from improper and unwarranted intrusions into their privacy. Chapter 85 indicates what data are to be collected by the Bureau, conditions for the dissemination of criminal history record information, procedures and parameters for access to files, and the furnishing of information on injured or deceased persons. Included is this compendium is Subchapter IV of Chapter 85, which pertains to the duties of the Child Sex Abuse Information Repository; this repository provides information on child sex abusers to specified agencies and organizations that may employ persons who work with children. Subchapter V specifies the information to be provided to child care agencies in a criminal background check on prospective employees. Subchapter VI addresses procedures and conditions for criminal background checks for employment related to the public schools. Chapter 86 of the Delaware Code pertains to the Delaware Criminal Justice Information System. The purpose of this chapter is to maintain an accurate and efficient criminal justice information system consistent with Chapter 85. Also included in this compendium are statutory provisions that address the expungement of criminal records, access to public records and meetings, Bureau of Identification rules regarding access to and review of criminal history records, and a statutory provision related to criminal history record checks for sales of firearms.
