This is a 1997 overview of Nevada law pertinent to the privacy and security of criminal justice information, with attention to the management of records on sex offenses and sex offenders.
Abstract

Eleven sections of the chapter focus on the operation of Nevada's central repository for records of criminal history. The creation of a record is mandated, and the duties and powers of the Nevada Highway Patrol Division with respect to criminal history information are indicated. General procedures for the dissemination of records are indicated, with attention to disclosures to crime victims. Other topics addressed in these sections are a log of dissemination of information or records, fees, inspection and correction of information or records, and the removal of certain records when the disposition of the case is favorable to the accused. Seven sections of the chapter address information relating to sexual offenses. One section states that notice of information may be disseminated to employers. Procedures for the dissemination of such information are detailed. One section mandates that a person who is the subject of a request for notice of information relating to sex offenses can file a civil claim for damages when the central repository or the employer do not comply with mandated procedures for information dissemination. Provisions also cover the sealing of records and the fingerprinting or photographing of a juvenile who is arrested or under investigation.
