This article demonstrates how creative implementation of trial motions compels disclosure of the defendant's strategy and evidence of the intended core defense in child abuse trials.
Abstract
The article reviews preemptive victim protection, conditions of release, protecting the victim during trial, discovery, and motions in limine. Trial motions can significantly influence the outcome of a child abuse case. As the state's use of trial motions becomes more sophisticated, judges will come to rely on these motions to present the correct law. The court will listen to innovative arguments and ultimately allow creative approaches promoting the pursuit of justice for children. Time and patience may be required in some jurisdictions, but persistence will reap valuable dividends. Notes
