This volume contains contributions by experts whose purpose is to advance the work of the 1997-98 Preparatory Committee for an International Criminal Court and to hasten the establishment of a fair and effective system of international criminal justice.
Abstract
A paper on the "Organization of the International Criminal Court: Administrative and Financial Implications" provides government experts the administrative facts and financial costs they need to assess the eventual working and implications of the prospective institution. Another paper discusses issues and prospects for the establishment of an International Criminal Court after the first session of the Preparatory Committee. The issues discussed are the subject-matter jurisdiction of the Court, the definition of crimes under general international law, the "complementarity" of the Court, and the mechanisms for "triggering" the Court's jurisdiction. A number of papers report on studies developed by the American Branch of the International Law Association's Committee on the International Criminal Court. They include the first Committee report on jurisdiction, which includes definitions of "crimes" and "complementarity." Reports to the Committee address jurisdiction, definition of crimes, and triggering mechanism; complementarity; cooperation with national systems; a critique of the Yugoslavia War Crimes Tribunal; general rules of criminal law; and Nullum Crimen and related crimes. Footnotes accompany each paper.
