This book presents the texts of leading constitutional cases about the investigation and prosecution of crime.
Abstract
The book describes selected provisions of the United States Constitution and then presents cases in the following categories: (1) Due Process of Law; (2) Fourth Amendment: Arrest and Search and Seizure; (3) Electronic Surveillance, Agents and Informers, and Entrapment; (4) Right to Counsel; (5) Privilege Against Self-Incrimination; (6) Lineups; (7) Preliminary Examination; (8) Bail; (9) Prosecution; (10) Indictment; (11) Right to Speedy Trial; (12) Plea-Bargaining; (13) Trial by Jury; (14) Trial; (15) Double Jeopardy; (16) Sentence; and (17) Collateral Attack. The book includes significant cases decided in the current term of the Supreme Court and excludes some that have lost significance. It also includes concurring and dissenting opinions that make a substantial contribution to discussion of the issue at stake. Separate opinions not reproduced in the book are indicated in a footnote at the end of the case, along with the votes of justices who did not join one of the reproduced opinions. Table, notes
