This is the Fourth Edition of the West Virginia Jury Instructions for criminal cases.
Abstract
This Fourth Edition of West Virginia Jury Instructions includes all the basic materials of the first three editions, with material added to reflect court decisions from April 1, 1994 through 472 S.E.2d and statutory changes through the 1996 Regular Session of the West Virginia Legislature. Instructions cover substantive law and include comments and research footnotes. The volume reviews presumption of innocence, reasonable doubt, burden of proof, alibi, and the basic elements of: most crimes against the person, crimes against property, driving under the influence of alcohol or drugs, sexual offenses, certain common law defenses, and general charges to the jury. The manual is not a substitute for research, but a guide to supplement research and assist in drafting jury instructions. Notes, references
