Abstract
A section on establishing facts and providing reasons contains articles on lawlessness in sentencing; establishing a factual basis for sentencing; criminal law as the missing element in sentencing reform; and reasons for sentence. "Having a Say on Sentence" presents articles on social inquiry for the courts; pre-sentence reports; the modern role of defense counsel and of crown prosecutor in the sentencing process; and victims' voices in criminal court.
