In accordance with Section 195 of Canada's Criminal Code, this 1998 Annual Report provides data on and a general assessment of the use of electronic surveillance in the judicially authorized interception of private communications.
Abstract
The report contains statistics for offenses in relation to which proceedings for electronic surveillance may be instituted at the instance of the Government of Canada and conducted by or on behalf of the Attorney General of Canada. The report covers applications for authorizations in relation to the offenses listed in a table of this report. The report also contains information related to certain Criminal Code offenses that occurred in the Northwest Territories, Nunavut or the Yukon, as well as offenses that meet either of the requirements mandated in section 2 of the Security Offences Act. Section II of the report provides an overview of the key procedural requirements of Part VI of the Criminal Code. Section III presents data provided by agents of the Solicitor General who are designated pursuant to paragraph 185(1)(a) of the Criminal Code and information and data contained in the operational reports of police forces that requested applications for authorized interception of private communications. Section IV provides a general assessment of the importance of electronic surveillance for the investigation, detection, prevention, and prosecution of offenses in Canada as required by subsection 195(3) of the Criminal Code. One appendix lists designated agents of the Solicitor General who made an application for an authorization in accordance with sections 185 and 487.01 of the Criminal Code. Another appendix lists designated peace officers who made an application for an authorization in accordance with sections 188 and 487.01 of the Criminal Code. 8 tables and 4 figures
