This volume presents the text of 30 appellate court decisions related to police supervision and covering issues that include sex discrimination, due process in a police disciplinary hearing, termination of employment, and other issues.
Abstract
The case summaries also focus on the dismissal of a permanent police employee, the discharge of a police officer for accepting a bribe, a driver fatality when a stolen car being driven at high speed crashed into a police roadblock, and police training related to the detention of an individual who needed medical care. Other cases involved an alleged violation of the Americans with Disabilities Act and the Rehabilitation Act of 1973, sex discrimination and sexual harassment, unlawful dismissal due to the police officer’s refusal to waive the privilege against self-incrimination, the alleged fixing of traffic tickets. Further cases focused on police use of force during an investigatory stop, police negligence related to an intoxicated driver involved in a fatal traffic accident, and a police officer’s refusal to comply with an order to provide a urine sample for drug testing.
