This 2002 Annual Report of the California Commission on Judicial Performance -- the independent State agency responsible for investigating complaints of judicial misconduct and judicial incapacity and for disciplining judges -- covers the Commission's activities for 2002 and summarizes the cases presented to the Commission.
Abstract
The report first presents an overview of the complaint process, followed by an explanation of the Commission's legal authority and a description of Commission procedures. Statistics for 2002 pertain to complaints filed against active and former judges. Statistics on complaints received and investigated pertain to new complaints, staff inquiries and preliminary investigations, and formal proceedings. Data are also provided on complaint dispositions. A section on case summaries distinguishes cases by those that involved public discipline (removal from office, public censure, and public admonishment) and private discipline (private admonishments and advisory letters). Case summaries also encompass decision and order of dismissal of formal proceedings. Another section of the report focuses on complaints against subordinate judicial officers. These statistics for 2002 address complaints received and investigated and the number of cases concluded. Statistics on judicial disability retirement are distinguished by voluntary and involuntary disability retirement. The concluding section of the report provides information on Commission organization, staff, and budget. Appendices contain Commission governing provisions, selected judicial opinions that affect the Commission, a 10-year summary of Commission activity, and a complaint form.
