This book examines the nature of four post-conflict situations in Kosovo, East Timor, Sierra Leone, and Cambodia regarding serious human rights violations and their enforcement and the legal framework established for addressing individual criminal responsibility.
Abstract
This book attempts a comprehensive examination of recent approaches to international criminal justice by focusing on four conflict situations, specifically in Kosovo, East Timor, Sierra Leone, and Cambodia, where serious human rights and international humanitarian law violations have taken place and where criminal accountability for these violations has or is being legislated. The book is divided into two major sections. Part 1 contains reports on Kosovo and East Timor, areas under a United Nations transitional administration with full executive, legislative, and judicial authority. Part 2 contains reports on Sierra Leone and Cambodia, countries where a special agreement with the U.N. allows for the prosecution of certain serious offenses. Each country section contains an introductory expose of the background and nature of the underlying conflict followed by a legal analysis and review of the framework upon which prosecutions and the court system are based. In addition, two articles are included dealing specifically with Kosovo (adjudication of crimes) and East Timor (serious crime investigations). The book serves as a sourcebook containing an indexed compendium of relevant instruments relating to the new approaches of international criminal justice applied in the countries mentioned.
