This annual report presents comprehensive information and statistics on the California Commission on Judicial Performance’s activities in the year 2004.
Abstract
The California Commission on Judicial Performance is the independent State agency responsible for investigating complaints of judicial misconduct and judicial incapacity and for disciplining judges. This report presents the activities and efforts for the year 2004 specifically, the Commission’s handling and disposition of complaints involving judges and discusses the rules and procedures for complaints involving commissioners and referees and statistics concerning those matters for 2004. The report continues with a discussion on the legal authority and procedures of the Commission, statistics on active and former judges related to complaints received and investigated and complaint dispositions, 2004 case summaries, and complaints filed against subordinate judicial officers and discipline imposed. For the first time, the report provides information on the diverse backgrounds of Commission members. In regards to the summaries of discipline, the report provides additional details to assist the public understanding and increase the value of the report as an educational tool for judges by highlighting problematic conduct. Appendixes 1-4
