This report provides updated information from the Conference of the Parties to the United Nations Convention Against Transnational Organized Crime regarding implementation information provided by state parties to the Convention during the first reporting cycle.
Abstract
The Conference of the Parties is designated by the Convention to administer the implementation of Convention provisions by the state parties that signed on to incorporate Convention provisions in their countries' laws and policies. After reviewing proceedings of the first two sessions of the Conference of the Parties, this report summarizes and analyzes state parties' replies to a questionnaire that solicited information on progress in complying with Convention provisions on countering transnational organized crime. The report first addresses progress in meeting Convention requirements for the criminalization of specified activities linked to transnational organized crime. Progress is indicated for the criminalization of the following activities: participation in an organized criminal group, laundering of the proceeds of crime, corruption of public officials, and obstruction of justice. Other legal matters discussed pertain to jurisdiction, the liability of legal persons, and confiscation and seizure of criminal proceeds. Also documented in this report are compliance with the Convention's international cooperation requirements, which pertain to extradition, mutual legal assistance, and international cooperation in the confiscation and disposal of criminal proceeds or property. The report also discusses the difficulties state parties have encountered in attempting to implement Convention provisions in their countries, as well as their need for technical assistance. The report notes that only 59 out of 122 state parties to the Convention have provided responses to the reporting questionnaire for the first cycle of progress reporting as of July 24, 2006. Recommendations are offered for improving progress reporting. 64 notes and appended listing of the status of response to the questionnaire for each state party
