This annual report presents the use of electronic surveillance in Canada for the years 2003 to 2007.
Abstract
Organized into three main sections, the 2007 annual report covers a 5-year period from 2003 to 2007. It includes statistical information from January 1, 2007, to December 31, 2007, and updates data for the years 2003 to 2006. Following an introduction, section 2 of the report provides an overview of the procedures and processes set out in Part VI of the Canadian Criminal Code for the law enforcement community to obtain judicial authorization to conduct electronic surveillance to assist in criminal investigations. In addition, requirements are presented that must be met to successfully apply for an authorization to intercept private communications. Section 3 presents the statistical information that must be included in each annual report pursuant to the Criminal Code. Section 4 provides a general assessment of the importance of electronic surveillance for the investigation, detection, prevention, and prosecution of offenses as required under the Criminal Code. Parts VI of the Canadian Criminal Code sets out procedures for the law enforcement community to obtain judicial authorization to conduct electronic surveillance of private communications to assist in criminal investigations, and are to be carried out ensuring the privacy of individuals during surveillance. As a measure of accountability, the Criminal Code requires the Minister of Public Safety and Emergency Preparedness to prepare and present to Parliament an annual report on the use of electronic surveillance under Part VI for offenses that may be prosecuted.
