This chapter attempts to outline the premise of this book and the need to start anew in responding to youth crime based on the deep-rooted problems in the current systems, laying out the task of the Independent Commission on Youth Crime and Antisocial Behavior; to reform the response to youth crime in England and Wales.
Abstract
The problems within the current youth justice system in England and Wales are intractable because of underlying tensions between different objectives. Even within the youth justice system in England and Wales, as well as in the adult system, punishment and retribution are essential elements and leading themes. Yet, punishment of young offenders conflicts with the need to help them to change, with the requirement to take account of their immaturity, and with the duty to promote their welfare. The second unresolved tension discussed is the clash between two conceptions of crime prevention. The Independent Commission on Youth Crime and Antisocial Behavior's task is to set out the framework for a new response to youth crime, with the aim of delivering justice to individual victims and young offenders in a way that is appropriate to their maturity and needs. There is wide scope for creating a more just and constructive system of youth justice. This book aims to fill out the context of evidence and analysis for designing that system. Notes and references
