This publication provides a glossary of terms for the Department of Justice (DOJ) Asset Forfeiture Program.
Abstract
Asset forfeiture has the power to disrupt or dismantle criminal organizations that would continue to function if we only convicted and incarcerated specific individuals. The Federal Asset Forfeiture Program provides for the seizure and forfeiture of assets that represent the proceeds of, or were used to facilitate Federal crimes. The Program employs asset forfeiture powers in a manner that enhances public safety and security by removing the proceeds of crime and other assets relied upon by criminals and their associates to perpetuate their criminal activity against our society. This glossary of terms enhances the understanding of forfeiture among non-lawyers who work in the Federal Asset Forfeiture Program. The entries are common-sense descriptions of terms and are not intended to be definitive. Any use of these or any other forfeiture terms in legal documents should be based on the writer's review of applicable statutes, regulations, and/or cases concerning the terms. Also provided is fill-in-the-blank and multiple-choice tests on the terms in the glossary.
