THE INHERENTLY COERCIVE NATURE OF CUSTODIAL INSTITUTIONS, STATES THE AUTHOR, ELIMINATES THE POSSIBILITY OF AN INMATE'S INFORMED CONSENT TO ALLOW HIS BODY TO BE EXPERIMENTED UPON.
Abstract
INFORMED CONSENT IMPLIES KNOWLEDGE, COMPETENCY, AND VOLUNTARINESS, AND THESE CONDITIONS ARE IMPOSSIBLE WHEN INDUCEMENTS SUCH AS EXTRA WAGES ARE AVAILABLE, OR, IN THE CASE OF INDETERMINATE SENTENCES, WHEN THE PRISONER BELIEVES THAT EVERYTHING HE DOES IN PRISON WILL AFFECT THE LENGTH OF HIS SENTENCE.
