RESULTS OF A 50-STATE QUESTIONNAIRE SURVEY ON THE EFFECT OF ORAL ARGUMENTS, THE ORDER OF CONFERENCE DISCUSSION, THE ORDER OF VOTING, AND THE ASSIGNMENT OF WRITTEN OPINIONS ON JUDICIAL BEHAVIOR AND CASE OUTCOME.
Abstract
THE AUTHOR SUGGESTS THAT ALTHOUGH THERE IS A WIDE DIVERSITY IN THE OPERATIONS OF STATE SUPREME COURTS, IN RELATION TO DECISION-MAKING PROCEDURES, THESE DIFFERENCES DO NOT AFFECT THE SUBSTANCE OF COURT DECISIONS OR THE ABILITY OF THE COURT TO FULFILL ADEQUATELY ITS CONSTITUTIONAL AND STATUTORY FUNCTIONS. STATE-BY-STATE DATA ON THE USE OF THE FOUR DECISION-MAKING PROCEDURES IS INCLUDED IN CHART FORM.
