THE AUTHOR SUGGESTS A NEW DEFINITION OF STATUS OFFENDER WHICH CONCENTRATES ON HOW THE CHILD CAME TO BE CONFINED AND DISCUSSES THE USEFULNESS OF THIS NEW DEFINITION.
Abstract
THE JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT CALLS FOR THE DEINSTITUTIONALIZATION OF JUVENILE STATUS OFFENDERS, BUT NO CLEAR DEFINITION OF STATUS OFFENDER IS OFFERED. THE AUTHOR REPORTS ON A CLASSIFICATION SYSTEM, AND SEVERAL VARIATIONS THEREOF, WHICH INCORPORATES AN OPERATIONAL DEFINITION OF STATUS OFFENDER WHICH STATE AND LOCAL GOVERNMENTS COULD USE TO DETERMINE WHETHER CONFINEMENT IN A DETENTION OR CORRECTIONAL FACILITY WOULD BE IN COMPLIANCE WITH THE ACT.
