THIS REPORT ANALYZES THE RANGE AND METHODS OF EXERCISING POLICE POWER IN VARIOUS COUNTRIES WITH REGARD TO THE DETENTION OF PERSONS WHO ARE NEITHER CHARGED NOR THE SUBJECT OF ARREST WARRANTS ISSUED BY A MAGISTRATE.
Abstract
A SURVEY OF 50 COUNTRIES WAS UNDERTAKEN. EACH COUNTRY'S SYSTEM IS PRESENTED IN FIVE PARTS: POLICE POWERS OF DETENTION; CONDITIONS FOR DETAINING A PERSON; PHYSICAL CONDITIONS OF DETENTION; RIGHTS OF DETAINED PERSONS AND SAFEGUARDS FOR THESE RIGHTS; AND CONSEQUENCES OF BREAKING THE REGULATIONS. THE COUNTRIES ARE GROUPED INTO VARIOUS CLASSIFICATIONS, DEPENDING ON THE RANGE AND TYPES OF THE POLICE POWERS.
