EXAMINATION OF THE ADMINISTRATION OF JUSTICE IN THE CANADIAN JUVENILE COURT SYSTEM USING THREE MODELS DEVELOPED TO ANALYZE THE CRIMINAL PROCESS.
Abstract
HERBERT PACKER'S 'CRIME CONTROL' AND 'DUE PROCESS' MODELS AND THE 'FAMILY' MODEL OF THE CRIMINAL PROCESS ARE OUTLINED AND EVALUATED. A BRIEF HISTORY OF THE JUVENILE COURTS IS PRESENTED AND DIVERGENT TRENDS IN THE US AND BRITISH JUVENILE JUSTICE SYSTEMS ARE EXAMINED. THE PRESENT CANADIAN SYSTEM AND A RECENT LEGISLATIVE PROPOSAL ARE STUDIED TO ASSESS VALUES BEHIND VARIOUS PROCEDURAL FRAMEWORKS. A CRITIQUE OF PROCEDURAL CONSEQUENCES USING JOHN GRIFFITH'S 'FAMILY' MODEL IS UNDERTAKEN.
