DISCUSSION OF CONSTITUTIONAL PROBLEMS CAUSED BY NONDISCOVERABILITY OF JUROR INFORMATION AVAILABLE TO COUNSEL BEFORE JUROR SELECTION IN CRIMINAL TRIALS.
Abstract
VIOLATIONS OF THE CRIMINAL DEFENDANT'S FAIR TRIAL AND DUE PROCESS RIGHTS AND THE GOVERNMENT'S RIGHT TO A FAIR AND IMPARTIAL JURY CAUSED BY THE AVAILABILITY OF PREDICTION OF JUROR BEHAVIOR BASED ON ACCURATE SOCIAL SCIENCE INVESTIGATIVE TECHNIQUES ARE EXAMINED. A SUGGESTION TO INSURE PROPER OPERATION OF THE JURY INSTITUTION BY ALLOWING MUTUAL PRE-VOIR DIRE DISCOVERY OF ALL JUROR INFORMATION IS MADE.
