THIS COMMENT ASSESSES TRADITIONAL AND MODERN PROCEDURES CURRENTLY USED FOR JUDGE DISCIPLINE AND REMOVAL AND COMPARES THE OPERATIONS OF THE WISCONSIN JUDICIAL COMMISSION WITH THEM.
Abstract
THIS COMPARISON IS UNDERTAKEN TO DETERMINE WHETHER THE COMMISSION, A COMBINATION OF TRADITIONAL AND MODERN APPROACHES, OFFERS A VIABLE ALTERNATIVE TO THE OTHER TWO PROCEDURES. THE AUTHOR DISCUSSES THE TRADITIONAL RECALL, ADDRESS, AND IMPEACHMENT APPROACHES STILL USED IN SEVERAL OF THE STATES AND IDENTIFIES THEIR FAILURE TO PROVIDE A PROCEDURAL DEVICE FOR THE EVALUATION OF COMPLAINTS AGAINST JUDGES. NEW YORK'S COURT ON THE JUDICIARY AND ITS LACK OF CONFIDENTIALITY OF PROCEEDINGS ARE EXAMINED AS IS THE MORE SUCCESSFUL CALIFORNIA JUDICIAL QUALIFICATIONS COMMISSION. THE COMPOSITION, FUNCTIONS, AND DEFICIENCIES OF THE WISCONSIN COMMISSION, WHICH OPERATES SIMILARLY TO THE CALIFORNIA COMMISSION WITH TRADITIONAL REMOVAL PROCEDURES, ARE EXAMINED. IT IS RECOMMENDED THAT LEGISLATION ENABLING THE STATE SUPREME COURT TO REMOVE OR RETIRE JUDGES BE ENACTED.
