DELINEATION OF WEST GERMANY'S TWO-TRACKED SYSTEM OF LONG TERM INSTITUTIONALIZED TREATMENT FOR JUVENILES WHICH PROVIDES FOR JUVENILE CORRECTIONS (JUGENDSTRAFUOLLZUG) AND JUVENILE SOCIAL WORK (FUERSORGEERZIEHUNG).
Abstract
JUVENILE CORRECTIONS IS BASED ON THE CRIMINAL LAW AND JUVENILE SOCIAL WORK IS BASED ON SOCIAL WELFARE LEGISLATION. THE STANDARDS, GOALS, AND IMPLEMENTATION OF THE TWO SYSTEMS REFLECT THEIR DIFFERENT LEGAL ORIGINS. THE MORE SERIOUS THE OFFENSE, THE MORE LIKELY IT IS THE OFFENDER WILL GO TO A CORRECTIONAL INSTITUTION. DESCRIBED ARE FEATURES OF A PROPOSED JUVENILE ASSISTANCE LAW (JUGENDHILFEGESETZ) WHICH WOULD PROVIDE FOR A NEW KIND OF INSTITUTION, THE SOCIAL THERAPEUTIC YOUTH CENTER, WHICH AIMS AT OVERCOMING THE DISADVANTAGES OF THE TWO-TRACKED SYSTEM. --IN GERMAN
