THIS REPORT PRESENTS THE FINDINGS OF A STUDY OF THE BRITISH LAWS ON CONSPIRACY UNDERTAKEN BY A WORKING PARTY OF THE LAW COMMISSION, AND INCLUDES THE COMMISSION'S RECOMMENDATIONS FOR REFORM OF THE CONSPIRACY LAWS.
Abstract
THE INITIAL SECTION OF THIS REPORT PROVIDES A COMPREHENSIVE DISCUSSION OF THE OFFENSE OF CONSPIRACY AND THE LEGAL HANDLING OF THIS OFFENSE. AMONG THE SPECIFIC TOPICS EXAMINED ARE THE NEED FOR AN OFFENSE OF CONSPIRACY, THE OBJECTIVE OF CONSPIRACY, THE ELEMENTS OF CONSPIRACY, AND THE PENALTIES FOR CONSPIRACY. IT IS CONCLUDED THAT CONSPIRACY SHOULD ONLY BE AN OFFENSE IF THE OBJECT OF THE AGREEMENT IS ITSELF A CRIMINAL OFFENSE. THE REPORT THEN PRESENTS MORE DETAILED ANALYSES AND RECOMMENDATIONS CONCERNING SPECIFIC TYPES OF CONSPIRACY, INCLUDING CONSPIRACY TO TRESPASS, CONSPIRACIES RELATING TO PUBLIC MORALS AND DECENCY, CONSPIRACIES TO EFFECT A PUBLIC MISCHIEF, AND CONSPIRACIES TO COMMIT A CIVIL WRONG. THE APPENDICES INCLUDE A DRAFT CONSPIRACY AND CRIMINAL LAW REFORM BILL WHICH INCORPORATES THE RECOMMENDATIONS MADE IN THE BODY OF THE REPORT.
