THIS STUDY OF THE ROLES, FUNCTIONS, DUTIES, POWERS, AND PROBLEMS OF COURT CLERKS IS FOCUSED ON THAT OFFICE IN THE STATE OF FLORIDA.
Abstract
OUT OF 67 QUESTIONNAIRES SENT TO CLERKS IN FLORIDA, 55 WERE RETURNED COMPLETED. IN ADDITION, A NUMBER OF CLERKS, DEPUTY CLERKS, COURT ADMINISTRATORS, AND CHIEF JUDGES WERE INTERVIEWED. THE STUDY REVEALED THAT DESPITE THE FACT THAT CLERKS ARE WELL-EDUCATED, THEY ARE RELATIVELY UNKNOWLEDGEABLE ABOUT MODERN TECHNOLOGY AND TECHNIQUES TO ASSIST IN THE OPERATION AND MANAGEMENT OF THEIR OFFICES. THE AUTHORS CONCLUDE THAT THIS, COUPLED WITH THE COUNTY COURT CLERK'S CONSERVATIVE NATURE, ACCOUNTS IN PART FOR THE CAUSE OF THE CONTINUED USE OF INEFFICIENT COURT PROCEDURES IN THE STATES.
