REPORT RECOMMENDS SIX SIGNIFICANT CHANGES IN HANDLING OF ASPECTS OF STATE JUVENILE JUSTICE SYSTEM.
Abstract
ONE OF THE SIX ATTORNEY GENERAL RECOMMENDATIONS INVOLVES AN ALTERATION IN THAT PART OF THE WELFARE AND INSTITUTIONS CODE THAT PROVIDES FOR INFORMAL PROBATION. IT SHOULD BE CHANGED TO PRESCRIBE A PROGRAM OF SUPERVISION AND REQUIRE A REPORT AT THE CONCLUSION OF PROBATION. THE AUTHORITY OF THE PROBATION OFFICER TO FILE THE WITHHELD PETITION IS ALSO BETTER DEFINED. A MAJOR RECOMMENDATION WOULD REQUIRE THE ADDITION OF A SECOND DETENTION HEARING WITHIN FIVE JUDICIAL DAYS TO CONSIDER EVIDENCE IF IT IS REQUESTED BY COUNSEL. SUCH DETENTION HEARINGS COULD THUS GUARD AGAINST UNWARRANTED DETENTION. STILL ANOTHER RECOMMENDATION INVOLVES REQUIRING THE DISTRICT ATTORNEY TO APPEAR AND PARTICIPATE IN HEARING ALL CASES INVOLVING VIOLATION OF THE CRIMINAL LAW....BS
