ARTICLE TRACES HISTORY OF JUVENILE TRANSFER IN ILLINOIS, AND EXAMINES ITS EFFICIENCY TODAY.
Abstract
ILLINOIS, THE FIRST STATE TO ENACT A JUVENILE COURT ACT, HAS NOT GONE FAR ENOUGH TO ASSURE AN ADEQUATE LEVEL OF PROTECTION TO JUVENILES IN THE TRANSFER PROCESS FROM JUVENILE STATUS TO ADULT STATUS. UNDER THE PRESENT PROCEDURE, THE HEARING MAY INVOLVE ONLY A RECITATION OF THE STATUTORY LIST OF CRITERIA FOR DECISIONMAKING, WHICH ARE LOOSELY DEFINED. THE STATE IS UNDER NO BURDEN TO REFUTE SPECIFIC EVIDENCE THAT MIGHT BE PRESENTED ON THE JUVENILE'S BEHALF CONCERNING HIS ADAPTABILITY TO JUVENILE COURT TREATMENT. HOWEVER, REVIEW OF THE JUVENILE COURT JUDGE'S TRANSFER DECISION IS NOW AVAILABLE FOR THE FIRST TIME IN THE STATE....BS
