REVIEW OF A FEDERAL COURT RULING IN SWEET V SOUTH CAROLINA DEPARTMENT OF CORRECTIONS (1975) WHICH HELD THAT INMATES IN PROTECTIVE CUSTODY SHOULD, AS FAR AS POSSIBLE, BE TREATED LIKE THE GENERAL INMATE POPULATION.
Abstract
EQUAL TREATMENT IS FURTHER REQUIRED WITHOUT REGARD TO EXPENSE. THE FACTS OF THE CASE AND THE COURT'S REASONING IN SWEET ARE EXAMINED AND WEAKNESSES ARE EMPHASIZED. THE AUTHOR CONCLUDES THAT FURTHER JUDICIAL SCRUTINY OF AREAS FORMERLY CONTROLLED BY PRISONERS AND ADMINISTRATORS WILL REQUIRE WILLINGNESS BY THE COURTS TO FAMILIARIZE THEMSELVES WITH THE SOCIETY AND RESOURCE ALLOCATION WITHIN PRISONS....EB
