REVIEW OF LEGISLATIVE AND PROCEDURAL CHANGES IN NEW JERSEY'S JUVENILE JUSTICE SYSTEM, INCLUDING RECOGNITION OF THE JUVENILE'S RIGHT TO DUE PROCESS AND SEPARATE PROCESSING FOR STATUS OFFENDERS.
Abstract
OTHER STATUTORY INNOVATIONS DISCUSSED ARE A REQUIREMENT THAT PROBABLE CAUSE BE DETERMINED PRIOR TO A WAIVER OF JURISDICTION TO THE CRIMINAL COURTS, A DE-EMPHASIS OF JUVENILE DETENTION AND SHELTER CARE, AND A JUDICIAL DECLARATION OF THE JUVENILE'S RIGHT TO TREATMENT. PROPOSALS FOR REFORM INCLUDE THE IMPLEMENTATION OF A FORMALIZED STATEWIDE INTAKE AND DIVERSION SYSTEM DESIGNED TO MINIMIZE THE INVOLVEMENT OF THE MARGINAL OFFENDER IN THE JUVENILE JUSTICE SYSTEM; UNIFICATION OF THE JUVENILE AND DOMESTIC RELATIONS COURT WITH MATRIMONIAL-CHANCERY INTO A SINGLE FAMILY COURT; AND JUVENILE PROCEDURES TRAINING FOR ALL PROSECUTORS, DEFENSE ATTORNEYS, AND OTHER PERSONNEL PARTICIPATING IN THE JUVENILE COURT PROCESS....ELW
