THIS REPORT, A PRODUCT OF THE JUDICIAL PLANNING ASSISTANCE PROJECT, DESCRIBES STATE ACTIONS TO INSTITUTIONALIZE JUDICIAL PLANNING, PLACING IT ON A PERMANENT, STATE-FUNDED BASIS IN STATE JUDICIAL SYSTEMS.
Abstract
IF THE INDEPENDENCE, EFFECTIVENESS, AND IMPARTIALITY OF THE ADJUDICATIVE PROCESS IS TO BE MAINTAINED, COURTS MUST EFFECTIVELY PERFORM THEIR OWN ADMINISTRATIVE FUNCTIONS, SUCH AS PLANNING. THIS REPORT DESCRIBES, FROM THE STATE LEVEL PERSPECTIVE, THE NATURE AND STATUS OF JUDICIAL PLANNING IN THE STATES AND PUERTO RICO. THE TEXT OPENS WITH A DEFINITION OF JUDICIAL PLANNING AND A DISCUSSION OF ITS LIMITATIONS AND UTILITY FOR THE COURTS. THE DEVELOPMENT OF PLANNING AS A FORMALIZED FUNCTION WITHIN THE ADMINISTRATIVE STRUCTURE OF STATE JUDICIARIES IS THEN DISCUSSED. NEXT, THE REPORT EXAMINES THE INSTITUTIONALIZATION OF PLANNING PROCESSES IN STATE COURT SYSTEMS BY FOCUSING ON RECENT DEVELOPMENTS IN FIVE STATES. A NUMBER OF STRATEGIC AND PRACTICAL CONSIDERATIONS FOR INSTITUTIONALIZATION ARE ALSO REVIEWED. FINALLY, A COMPREHENSIVE ANALYSIS OF THE STATUS OF PLANNING IN STATE COURT SYSTEMS IS PRESENTED. THE REPORT PROVIDES A POINT-BY-POINT SUMMARY OF THE FINDINGS OF A 1976 NATIONAL SURVEY ON JUDICIAL PLANNING CONDUCTED BY THE COUNCIL OF STATE GOVERNMENTS. RESULTS OF THE SURVEY ARE ANALYZED AND SEVERAL RELATIONSHIPS OR INTERPRETATIONS ARE DRAWN FROM THE FINDINGS. (AUTHOR ABSTRACT MODIFIED)...DMC
