EXAMINATION OF SPAIN'S CONTEMPORARY SITUATION IN RELATION TO POLITICAL CRIMES AND OFFENSES UNDER SPANISH CRIMINAL LAW.
Abstract
THE ANALYSIS IS DIVIDED INTO THREE DISTINCT SECTIONS. PART ONE TAKES A HISTORICAL AND CONCEPTUAL LOOK AT THE NATURE OF POLITICAL CRIME IN SPAIN AND HOW IT IS DEALT WITH UNDER NATIONAL LEGISLATION. PART TWO IDENTIFIES AND ANALYZES SOME OF THE MOST COMMON POLITICAL OFFENSES COMMITTED IN SPAIN (ASSOCIATION, ASSEMBLY, AND DEMONSTRATION, ILLEGAL PROPAGANDA, PUBLIC DISORDERS) AS WELL AS THE MORE SERIOUS AND CONSEQUENTIAL CRIMES, SUCH AS ATTACKS AGAINST THE SPANISH GOVERNMENT AND CIVIL AND MILITARY TERRORISM. PART THREE DISCUSSES THE TRIBUNAL OF PUBLIC ORDER, THE SPECIAL COURT HAVING JURISDICTION OVER THE HANDLING OF POLITICAL OFFENSES, AND BRIEFLY OUTLINES THE JUDICIAL PROCESS UTILIZED IN TRYING SUCH CASES.
