THIS MANUAL PROVIDES DESCRIPTIONS OF AND MATERIALS NEEDED TO IMPLEMENT A SYSTEM TO UPGRADE CRIMINAL PROSECUTIONS BY TRAINING LEGAL ASSISTANTS TO HANDLE NONPROFESSIONAL ACTIVITIES ASSOCIATED WITH ROUTINE CRIMINAL CASES.
Abstract
THE SYSTEM WAS DEVELOPED TO MATERIALLY REDUCE THE TIME REQUIRED BY UTAH'S COUNTY ATTORNEYS WITHOUT SIGNIFICANTLY INCREASING THAT REQUIRED BY THE LEGAL ASSISTANT. THE PROFESSIONAL SERVICES REQUIRED IN A ROUTINE CRIMINAL CASE ARE INFORMATION GATHERING AND LEGAL DECISIONMAKING; THE NONPROFESSIONAL RESPONSIBILITY INVOLVES PREPARING LEGAL DOCUMENTS BASED ON LEGAL DECISIONS MADE BY THE COUNTY ATTORNEY. TWO TYPES OF LEGAL FORMS WERE PREPARED BASED ON THIS APPRAISAL OF THE DIVISION OF DUTIES - THOSE TO BE USED IN INFORMATION GATHERING AND MAKING LEGAL DECISIONS AND THOSE DESIGNATED AS LEGAL INSTRUMENTS TO CARRY OUT THE DECISIONS MADE. THE MANUAL CONTAINS EIGHT SECTIONS: AN INTRODUCTION, ATTORNEY INSTRUCTIONS, MASTER INFORMATION LIST (MIL), LEGAL ASSISTANT INSTRUCTIONS, SPECIAL INFORMATION LIST (SIL), FORMS, MONITOR SYSTEM, AND AN INDEX. A FLOW CHART OF THE UTAH FELONY SYSTEM AND A GLOSSARY OF TERMS ARE INCLUDED....EB
