U.S. SUPREME COURT RULINGS PERTAINING TO THE EXCLUSIONARY RULE, EVIDENCE GATHERING, SURVEILLANCE AND EXAMINATION OF SUSPECTS, AND VARIOUS MATTERS OF ADJUDICATION ARE GIVEN. FOR MOST CASES, COURT SYLLABUS IS SUPPLIED.
Abstract
MOST OF THE DECISIONS ARE SUPPLEMENTAL TO THOSE INCLUDED IN EARLIER VOLUMES; HOWEVER, IN A FEW CASES THE EXPERTS CONSULTED SUGGEST THAT THE NEW OPINIONS BE SUBSTITUTED FOR OPINIONS PREVIOUSLY SET FORTH. IN GENERALS, THIS MATERIAL COVERS CRIMINAL JUSTICE CASES DECIDED IN 1975 AND 1976 COURT SITTINGS. THE COURT'S SYLLABUS IS SUPPLIED RATHER THAN EXCERPTS FROM THE DECISION, ALTHOUGH FOR A FEW NOTABLE CASES, THE MAJOR PORTION OF THE COURT OPINION IS GIVEN. INVESTIGATION ISSUES COVERED INCLUDE: THE EXCLUSIONARY RULE OF THE FOURTH AMENDMENT, ARTICLES SUBJECT TO SEIZURE, THE WARRANTLESS QUEST, SURVEILLANCE OF A SUSPECT AT LIBERTY, EXAMINATION OF A SUSPECT IN CUSTODY, AND DEVELOPING EVIDENCE FROM THE DEFENDANT AFTER ACCUSATION.
