THIS IS A COPY OF A PROPOSED STATUTE WHICH WOULD AMEND NEBRASKA LAW TO BRING IT INTO CONFORMANCE WITH SECTION 524 (B) OF THE CRIME CONTROL ACT OF 1973 AND WOULD ESPECIALLY LIMIT DISSEMINATION OF CRIMINAL
Abstract
HISTORY DATA. THIS PROPOSED LAW WOULD PROVIDE FOR TWO DIFFERENT FORMS OF RECORD AUDITING TO ENSURE (1) THE ACCURACY AND COMPLETENESS OF ALL CRIMINAL HISTORY INFORMATION INCLUDING DISPOSITION OF CASE, AND (2) THAT ALL USERS OF THE INFORMATION REPOSITORY ARE COMPLYING WITH THE ACT. CRIMINAL JUSTICE AGENCIES ARE REQUIRED TO MAINTAIN A LIST OF ALL RECORDS WHICH THEY DISSEMINATE TO SUPPORT THE AUDIT FUNCTION AND AS A MEANS TO CORRECT ERRONEOUS DISSEMINATION. LIMITATIONS ON DISSEMINATION OF JUVENILE RECORDS ARE MADE MORE SPECIFIC. THE DEPARTMENT OF JUSTICE OPINION THAT THIS PROPOSED STATUTE IS IN CONFORMANCE WITH THE CRIME CONTROL ACT, THE REQULATIONS AUTHORIZING ACCESS AND REVIEW WHICH SUPPORT THIS STATUTE, THE CERTIFICATION OF THE PLAN, AND THE LETTER OF PLAN ACCEPTANCE ARE ALSO INCLUDED. THE NEBRASKA STATE PATROL WILL BE IN CHARGE OF AUDITING ACCESS TO CRIMINAL HISTORY RECORDS. A COPY OF THIS AGREEMENT IS ALSO APPENDED.
