THIS BILL TO CODIFY, REVISE, AND REFORM TITLE 18 OF THE UNITED STATES CODE GATHERS TOGETHER LAWS RELATING TO SIMILAR OFFENSES, ELIMINATES DUPLICATIONS, AND RESOLVES INCONSISTENCIES IN THE FEDERAL CRIMINAL CODE.
Abstract
THIS COMPREHENSIVE NEW BILL COVERS: FEDERAL JURISDICTION; BARS TO PROSECUTION; TREASON AND RELATED OFFENSES; SABOTAGE AND RELATED OFFENSES; ESPIONAGE AND RELATED OFFENSES; ATOMIC ENERGY OFFENSES; OFFENSES INVOLVING FOREIGN RELATIONS, IMMIGRATION, NATURALIZATION, AND PASSPORTS; OBSTRUCTING A GOVERNMENT FUNCTION BY FRAUD, PHYSICAL INTERFERENCE, OR IMPERSONATING AN OFFICIAL; OBSTRUCTIONS OF LAW ENFORCEMENT INCLUDING BAIL JUMPING, ESCAPE, PROVIDING OR POSSESSING CONTRABAND IN A PRISON, AND FLIGHT TO AVOID PROSECUTION OR APPEARING AS A WITNESS; OBSTRUCTIONS TO JUSTICE INCLUDING WITNESS BRIBERY OR CORRUPTION, RETALIATING AGAINST A WITNESS, MONITORING JURY DELIBERATIONS, TAMPERING WITH A JURY, AND DEMONSTRATING TO INFLUENCE A JUDICIAL PROCESS; CONTEMPT OFFENSES; PERJURY, FALSE STATEMENTS, AND RELATED OFFENSES; AND COMMERCIAL BRIBERY AND RELATED OFFENSES. THE TAX CODE HAS BEEN INCORPORATED INTO THIS BILL, INCLUDING BOTH INTERNAL REVENUE OFFENSES AND CUSTOMS OFFENSES. VARIOUS LAWS COVERING CIVIL RIGHTS, POLITICAL RIGHTS, AND PRIVACY HAVE BEEN GATHERED TOGETHER INTO A CHAPTER ON 'OFFENSES INVOLVING INDIVIDUAL RIGHTS.' CHAPTERS ON 'OFFENSES INVOLVING THE PERSON' AND 'OFFENSES INVOLVING PROPERTY' CODIFY CURRENT LAWS AGAINST MURDER, RAPE, AGGRAVATED BATTERY, KIDNAPPING, HIJACKING, BURGLARY, ETC., AND SPECIFY FEDERAL JURISDICTION WHEN THE CRIME IS COMMITTED AGAINST A UNITED STATES OFFICIAL, A FEDERAL EMPLOYEE WHILE IN PERFORMANCE OF HIS DUTIES, A FOREIGN DIGNITARY OR MEMBER OF HIS IMMEDIATE FAMILY WHO IS IN THE UNITED STATES, A FOREIGN OFFICIAL IN THE UNITED STATES ON OFFICIAL BUSINESS, AN OFFICIAL GUEST OF THE UNITED STATES, OR AN INTERNATIONALLY PROTECTED PERSON. THERE IS ALSO FEDERAL JURISDICTION IF THE U.S. MAIL WAS INVOLVED OR IF THE CRIME WAS PART OF A FEDERAL OFFENSE DETAILED ELSEWHERE IN THE CODE. AS IN THE PAST, THE FEDERAL GOVERNMENT HAS JURISDICTION OVER FEDERAL LANDS. THE CHAPTER ON 'OFFENSES INVOLVING PUBLIC ORDER, SAFETY, HEALTH, AND WELFARE' COVERS ORGANIZED CRIME OFFENSES AND DRUG OFFENSES, EXPLOSIVES AND FIREARMS, RIOT OFFENSES, GAMBLING, OBSCENITY, PROSTITUTION, PUBLIC HEALTH OFFENSES (INCLUDING CRIMINAL PROVISIONS NOW FOUND IN THE FOOD AND DRUG ACT AND THE ENVIRONMENTAL PROTECTION ACT AS WELL AS A NUMBER OF OTHER LAWS WITH CRIMINAL PENALTIES), AND MISCELLANEOUS OFFENSES. SENTENCING, TRIAL PROCEDURES, JUVENILES, PERSONS JUDGED INCOMPETENT, AND ANCILLARY CIVIL PROCEEDINGS ARE COVERED IN THE FINAL SECTIONS.
