Abstract
THE NATURE OF CRIME AND THE CRIMINAL JUSTICE PROCESS, BASIC LEGAL DOCTRINES AFFECTING THE POLICE FUNCTION, PROBLEMS ENCOUNTERED IN THE WARRANT PROCESS, THE DETENTION OF PERSONS AND SEARCHES INCIDENT TO THE DETENTION, ELECTRONIC SURVEILLANCE, AND UNDERCOVER INVESTIGATIONS ARE DETAILED. FULL TEXTS OF APPLICABLE COURT CASES ARE REPRINTED. THE ROLE OF POLICE DISCRETION IN THE CRIMINAL PROCESS IS EXAMINED THROUGH ESSAYS AND OBSERVATIONS AS WELL AS COURT CASES. LEGAL IMPLICATIONS OF CONFESSIONS ARE DISCUSSED IN DETAIL, AS ARE EYEWITNESS IDENTIFICATIONS. THE EXCLUSIONARY RULE AND INTERNAL POLICE CONTROLS ARE ALSO CONSIDERED. THE MATERIALS ON PROSECUTION AND ADJUDICATION INCLUDE SUPREME COURT DECISIONS AFFECTING PRETRIAL PROCEDURES, ADJUDICATION OF GUILT BY PLEA, ADJUDICATION OF GUILT OR INNOCENCE BY TRIAL, THE RIGHT TO ADEQUATE DEFENSE, AND THE DEFENDANT'S OPPORTUNITY TO CHOOSE COUNSEL OR SELF-REPRESENTATION. THIS REVISION OF AN EARLIER TEXT IS NARROWER IN SCOPE, ENABLING EXPANSION OF THE SECTIONS RELATED TO POLICE INVESTIGATION, UNDERCOVER OPERATIONS, INTERROGATION, AND PRETRIAL MOTION PRACTICES. MATERIALS ON JUVENILE JUSTICE, THE MENTAL HEALTH PROCESS, AND CORRECTIONS FOUND IN THE ORIGINAL 1971 EDITION HAVE BEEN REVISED AND PUBLISHED SEPARATELY.
