Abstract
THE OUTGROWTH OF COURSES TAUGHT IN WASHINGTON, D.C., HIGH SCHOOLS AND ADULT AND JUVENILE CORRECTIONAL INSTITUTIONS, THIS TEXTBOOK HAS BEEN ADAPTED FROM AN EARLIER EDITION SO THAT IT CAN BE USED IN ANY STATE. A CHAPTER ON LEGAL RESEARCH COVERS MAKING LAWS, TOOLS FOR RESEARCHING A LEGAL ISSUE, REVIEWING A CASE, CITING CASES, AND SHEPARDIZING (USING A RESOURCE CALLED 'SHEPARD'S TO DETERMINE CASE AND STATUTE STATUS). GENERAL SENTENCING RULES; TYPES OF SENTENCES, SUCH AS MANDATORY MINIMUM SENTENCES, MULTIPLE OFFENSE SENTENCES, AND CONCURRENT-CONSECUTIVE SENTENCES; ALTERNATIVES TO INCARCERATION, INCLUDING SUSPENDED SENTENCE, PROBATION, RESTITUTION, FINES, AND WORK RELEASE; SPECIAL SENTENCING STATUTES; AND CREDIT FOR TIME SERVED IN PRISON ARE TREATED IN A SECTION ON SENTENCING. A MORE DETAILED EXAMINATION OF PROBATION, E.G., ELIGIBILITY, CONDITIONS, AND REVOCATION, IS OFFERED. TYPES OF POSTCONVICTION RELIEF DISCUSSED INCLUDE APPEALS, MOTIONS FOR A NEW TRIAL, HABEAS CORPUS, AND MOTIONS TO CORRECT OR REDUCE SENTENCE. RIGHTS OF PRISONERS ARE EXAMINED IN TERMS OF ACCESS TO THE COURTS AND RIGHTS UNDER THE FIRST, FOURTH, AND EIGHTH AMENDMENTS. DUE PROCESS RIGHTS IN PRISON INVOLVE DISCIPLINARY HEARINGS, TRANSFERS, AND DETAINERS. ACTIONS IN STATE AND FEDERAL COURTS BY STATE AND FEDERAL PRISONERS ARE NOTED REGARDING ALTERNATIVE REMEDIES TO ENFORCE PRISONER RIGHTS. PAROLE ELIGIBILITY, CONDITIONS, REVOCATION, AND LOSS OF RIGHTS ARE TREATED. APPENDIXES PRESENT STATUTES PERTAINING TO THE LAW OF CORRECTIONS, A LIST OF RESOURCES AND PRISONER LEGAL ASSISTANCE GROUPS, A SAMPLE COMPLAINT IN A CIVIL RIGHTS ACTION, AND TWO SAMPLE WRITS OF HABEAS CORPUS.
