SUMMARIES OF THE APPLICATIONS TO AND DECISIONS OF THE ONTARIO CRIMINAL INJURIES COMPENSATION BOARD DURING THE REPORTING PERIOD AND STATISTICS REGARDING THE AMOUNTS AWARDED TO VICTIMS ARE PRESENTED.
Abstract
CANADA'S COMPENSATION FOR VICTIMS OF CRIME ACT OF 1971 CREATED THE ONTARIO CRIMINAL INJURIES COMPENSATION BOARD. THE BOARD CONSIDERS APPLICATIONS FOR INJURIES RECEIVED BY VICTIMS DURING CRIMINAL ACTS. IT MUST WEIGH ALL RELEVANT CIRCUMSTANCES SURROUNDING THE CASE AND DETERMINE WHETHER AN AWARD FOR DAMAGES IS WARRANTED, AND IF SO, IN WHAT AMOUNT. INADEQUATE STAFFING WAS ONE OF THE MAJOR PROBLEMS ENCOUNTERED BY THE BOARD DURING THE REPORTING PERIOD. DURING THIS TIME, IT HEARD 608 APPLICATIONS AND AWARDED A TOTAL $1,423,640.93. THE AVERAGE AWARD WAS $1,958.69. A COMPARITIVE SUMMARY OF THE THREE PREVIOUS FISCAL YEARS IS PRESENTED. NUMBERS OF APPLICATIONS RECEIVED AND HEARD AND AMOUNTS OF AWARDS INCREASED SIGNIFICANTLY EACH YEAR. SUMMARIES OF APPLICATIONS AND AWARDS BY GEOGRAPHICAL AREA ARE ALSO PRESENTED. BRIEF ACCOUNTS OF EVERY SECOND CASE HANDLED BY THE BOARD ARE PROVIDED. A DESCRIPTION OF THE CIRCUMSTANCES OF THE CRIME AND INJURIES SUFFERED BY THE VICTIM, AS WELL AS THE AMOUNT AWARDED (IF THE BOARD RULED THAT AN AWARD WAS JUSTIFIED) ARE INCLUDED. SUMMARIES OF DISALLOWED APPLICATIONS ARE ALSO PRESENTED. (VDA)
