A YEAR-END REPORT IS PRESENTED REGARDING A CANADIAN LAW REFORM COMMISSION'S PROGRESS IN THE AREA OF PRIVATE LAW.
Abstract
THE LAW REFORM COMMISSION OF BRITISH COLUMBIA WAS CONSTITUTED BY THE LAW REFORM COMMISSION ACT, WHICH BECAME LAW ON JULY 1, 1969; THIS REPORT MARKS THE EIGHTH FULL YEAR OF ITS OPERATION. DURING 1977, SIX FORMAL REPORTS WERE SUBMITTED TO THE ATTORNEY GENERAL FOR BRITISH COLUMBIA. THEY INCLUDED REPORTS ON THE RULE IN HOLLINGTON V. HEWTHORN, WAIVER OF CONDITIONS PRECEDENT IN CONTRACTS, PROOF OF MARRIAGE IN CIVIL PROCEEDINGS, THE FRAUDS STATUTE, THE TORT LIABILITY OF PUBLIC BODIES, AND THE OFFENCES AGAINST THE PERSON ACT - 1828. A WORKING PAPER ON THE REPLEVIN ACT WAS ALSO ISSUED. THE CONTENT OF THESE DOCUMENTS IS DESCRIBED. IN ADDITION TO THESE REPORTS, IN-PROGRESS WORK IS ALSO NOTED REGARDING DEBTOR-CREDITOR RELATIONSHIPS; TORT LIABILITY OF PUBLIC BODIES; STATUTE LAW REVISION: APPLICABILITY OF ENGLISH LAW; THE LAW OF EVIDENCE; STATUTE OF FRAUDS; ARBITRATION; CIVIL PROCEDURE; WAIVER OF CONDITIONS PRECEDENT IN CONTRACTS; AND ESTATES PROJECTS. APPENDED MATERIALS INCLUDE A TABLE LISTING ALL REPORTS WHICH THE COMMISSION HAS MADE TO DATE WITH REFERENCES TO LEGISLATION IN WHICH RECOMMENDATIONS HAVE BEEN IMPLEMENTED IN WHOLE OR IN PART, AND A TABLE INDICATING MATTERS NOW UNDER CONSIDERATION. IT IS NOTED THAT THERE ARE 17 COMMISSION REPORTS WHOSE CENTRAL RECOMMENDATIONS HAVE NOT BEEN IMPLEMENTED BY THE LEGISLATURE. (RCB)
