A METHOD FOR ESTIMATING THE PROBABLE DURATION OF LITIGATION IN JUDICIAL AND ADMINISTRATIVE PROCEEDINGS IS DESCRIBED AND APPLIED TO STATISTICS ON CIVIL LITIGATION
Abstract
THE PROPOSED EQUATION USES THE NUMBER OF CASES PENDING AT THE BEGINNING OF A YEAR AND THE NUMBER OF CASES FILED DURING THAT YEAR -- DATA REGULARLY COMPILED AND PUBLISHED IN MANY COUNTRIES -- TO ESTIMATE THE PROBABLE DURATION OF LITIGATION. SUCH A FORMULA SHOULD BE USEFUL TO ATTORNEYS AND THEIR CLIENTS IN DEVELOPING LITIGATION STRATEGIES, TO JUDGES AND ADMINISTRATORS IN STAFFING TRIBUNALS, TO REFORMERS IN ESTABLISHING POLICY FOR JUDICIAL ADMINISTRATION, AND TO SOCIAL SCIENTISTS IN STUDYING THE INTERFACE BETWEEN SOCIETY AND LEGAL REFORMS. DETAILS OF THE EQUATION ARE PRESENTED, TOGETHER WITH AN ILLUSTRATION OF ITS APPLICATION. (LKM)
