A BROAD DESCRIPTION OF THE CURRENT CRIMINAL JUSTICE SITUATION IN INDIA IS GIVEN, WITH SPECIAL ATTENTION TO FEATURES UNIQUE TO INDIA AND THOSE DIFFERING IN PARTICULAR FROM STANDARD JAPANESE PRACTICE.
Abstract
THE ARTICLE SURVEYS INDIAN CRIMINAL LAW AND ITS APPLICATION CURRENTLY, WITH ATTENTION GIVEN ESPECIALLY TO FEATURES NOT COMMON IN JAPANESE COUNTERPART SITUATIONS. THE LEGAL APPROACH OF THE INDIAN CONSTITUTION IS DISCUSSED THE ARTICLE DESCRIBES THE APPLICATION OF LEGAL POLICY ON A NATIONAL LEVEL THROUGH SUCH ORGANIZATIONS AS THE CENTRAL INVESTIGATION BUREAU, BASED ON A LEGAL SYSTEM INITIATED ORIGINALLY IN 1861 UNDER BRITISH INFLUENCE. THE INDIAN COURT SYSTEM IS ALSO DESCRIBED, AS WELL AS TRENDS IN CRIME FROM 1962-1972. ALL TYPES LISTED SHOWED AN INCREASE OVER THE PERIOD AS A WHOLE, INCLUDING JUVENILE CRIMES. SPECIAL ATTENTION IS GIVEN TO PECULIARITIES OF THE INDIAN CRIMINAL JUSTICE SYSTEM, SUCH AS THE DIVISION OF OFFENSES INTO COGNIZABLE AND NONCOGNIZABLE ONES. THERE IS ALSO A DISCUSSION OF THE INDIAN TREATMENT OF HOMICIDE WHICH IS DIVIDED INTO THREE TYPES: MURDER, CULPABLE HOMICIDE NOT AMOUNTING TO MURDER, AND OTHER HOMICIDES NOT FALLING INTO EITHER OF THESE TWO CATEGORIES. A RELATIVELY FULL TREATMENT OF WHITE-COLLAR CRIME IN INDIA TODAY AND ITS GENERAL CURRENT IMPACT IS GIVEN. --IN JAPANESE.
