THIS BOOK REVIEWS SIGNIFICANT CRIMINAL CASES TO ILLUSTRATE THE PROFILE ASSUMED BY THE UNITED STATES SUPREME COURT AND EXAMINES THE IMPACT OF THE COURT ON STATE AND FEDERAL CRIMINAL JUSTICE SYSTEMS.
Abstract
A QUICK REFERENCE COMMENTARY GIVING A TERM-BY-TERM, CASE-BY-CASE SUMMARY OF ALL CRIMINAL LAW RULINGS HANDED DOWN BY THE UNITED STATES SUPREME COURT DURING THE PERIOD 1960 TO 1977 IS PROVIDED. THE CRIMINAL LAW REVOLUTION WAS CHARACTERIZED BY DRAMATIC CHANGES BROUGHT ABOUT BY THE COURTS EXTENSION OF FEDERAL PROTECTION TO PERSONS ACCUSED IN STATE CRIMINAL PROCEEDINGS AND OCCURRED DURING THE PERIOD 1961 TO 1969. IT ENCOMPASSED NINE TERMS OF THE WARREN COURT DURING WHICH THE FOURTEENTH AMENDMENT WAS ENFORCED IN ORDER TO GUARANTEE THE FOURTH, FIFTH, AND SIXTH AMENDMENTS IN ALL STATES. THE AFTERMATH OF THE REVOLUTION COVERS THE FIRST EIGHT TERMS OF THE BURGER COURT, DURING WHICH CONSOLIDATION OF EARLIER GAINS IN PROTECTIONS FOR DEFENDANTS, RETRENCHMENT RELATING TO SEARCHES AND SEIZURES, AND THE PRIVILEGE AGAINST SELF-INCRIMINATION WERE EMPHASIZED. SUMMARIES OF 684 CASES ARE GIVEN UNDER 125 SUBJECT HEARINGS. A BRIEF INTRODUCTION, PROVIDED AT THE BEGINNING OF THE DISCUSSION OF EACH CHIEF JUSTICE'S TERM, DETERMINES THE FOCUS OF DECISIONS MADE DURING THAT TIME. CASES CITED ARE TABULATED ALPHABETICALLY AND BY SUBJECT CLASSIFICATIONS. (JCP)
