THE LEGAL ASPECTS OF TRANSNATIONAL TERRORISM ARE EXAMINED IN TERMS OF THE NATURE, SCOPE, AND TARGETS OF THE TERRORIST THREAT AND POSSIBLE NATIONAL, REGIONAL, AND GLOBAL RESPONSES AND COUNTERMEASURES.
Abstract
THE FIRST SECTION OF THIS ANTHOLOGY CONCENTRATES ON TERRORISTS' THREATS AND SOCIETAL VULNERABILITY, WHILE THE SECOND SECTION FOCUSES ON INTERNATIONAL AND TRANSNATIONAL EFFORTS TO PREVENT AND CONTROL TERRORISM. THE FOLLOWING TARGETS ARE DISCUSSED: AIRCRAFT AND AVIATION FACILITIES, NUCLEAR MATERIALS AND FACILITIES, OCEAN VESSELS AND OFFSHORE STRUCTURES, PROTECTED PERSONS AND DIPLOMATIC FACILITIES, UNPROTECTED PERSONS, AND PERSONNEL AND PROPERTY OF TRANSNATIONAL BUSINESS OPERATIONS. NEW VULNERABILITIES (I.E., WATER SUPPLY SYSTEMS, VITAL UTILITIES) AND TERRORISTS' ACQUISITION OF NEW WEAPONRY (I.E., CHEMICAL AND BIOLOGICAL WEAPONS, NUCLEAR DEVICES) ARE ALSO DISCUSSED. A DESCRIPTION OF THE DILEMMAS POSED BY EACH TARGET IS ACCOMPANIED BY ASSESSMENTS OF RELEVANT NATIONAL AND INTERNATIONAL LAWS AND SANCTIONS AND A DISCUSSION OF THE POLITICAL, ECONOMIC, AND SOCIAL MILIEUS IN WHICH SUCH A THREAT MIGHT OCCUR. RECOMMENDED CHANGES IN NATIONAL AND INTERNATIONAL LAW ARE ALSO PROVIDED. PREVENTION AND CONTROL EFFORTS AND COUNTERMEASURES ARE OUTLINED, WITH EMPHASIS ON AN INTERNATIONAL CONTROL SCHEME FOR THE PROSECUTION OF INTERNATIONAL TERRORISM, PROBLEMS IN THE APPREHENSION AND PROSECUTION OF TERRORISM, PRACTICAL PROBLEMS FOR LAW ENFORCEMENT, PRIVATE SANCTIONS, CRIMINOLOGICAL POLICY, AND AN EXAMINATION OF THE RELATIONSHIP BETWEEN STATE SELF-HELP AND PROBLEMS OF INTERNATIONAL LAW. APPENDED MATERIALS INCLUDE CONCLUSIONS AND RECOMMENDATIONS ON DRAFTING GENERAL TREATY LAW, PROMOTING COOPERATIVE NATIONAL ACTION, EDUCATION PROGRAMS CONCERNING THE THREAT TO HUMAN RIGHTS, MEDIA GUIDELINES FOR RESPONSIBLE REPORTING OF TERRORIST INCIDENTS, AND NEGOTIATIONS AS AN INAPPROPRIATE SUBJECT FOR LEGISLATION.
