THIS TRANSLATION OF THE PENAL CODE OF FINLAND INCLUDES A NOTE ON THE CODE'S HISTORY, DEFINITION OF TERMS USED IN THE CODE, AND EXPLANATION OF ELEMENTS THAT ARE NO LONGER PERTINENT TO THE CRIMINAL JUSTICE SYSTEM.
Abstract
THE PENAL CODE OF FINLAND DATES BACK TO 1889, AND ALTHOUGH MANY OF ITS PROVISIONS HAVE BEEN AMENDED, NO COMPLETE OVERHAUL OF THE CODE HAS BEEN MADE; OBSOLETE REFERENCES WITHIN THE CODE ARE IN PARENTHESES. THE CODE CONTAINS PROVISIONS ON TYPES OF PUNISHMENTS ALLOWABLE IN FINLAND, GROUNDS FOR REMOVING OR DIMINISHING THE PUNISHABILITY OF AN ACT, MEASUREMENT OF SENTENCES, DEFINITIONS OF TREASONABLE OFFENSES, OFFENSES AGAINST A PUBLIC AUTHORITY, FAMILY RIGHTS AND MARRIAGE OFFENSES, OFFENSES AGAINST THE LIFE AND HEALTH OF OTHER PERSONS, DRUNKEN DRIVING, DISTURBING THE PEACE, THEFT, EMBEZZLEMENT, ROBBERY AND EXTORTION, HUNTING AND FISHING OFFENSES, PROPERTY DAMAGE, FRAUD AND FORGERY, MONETARY OFFENSES, AND WHITE-COLLAR CRIMES. THE GENERAL PUNISHMENTS IN FINLAND ARE IMPRISONMENT UP TO 12 YEARS OR LIFE SENTENCES AND FINES. FINES ARE IMPOSED AS DAY FINES AND AMOUNT TO ONE-THIRD OF THE AVERAGE GROSS DAILY INCOME OF THE PERSON. THE FINES CAN BE CONVERTED TO A PRISON SENTENCE IF THE OFFENDER FAILS TO MAKE PAYMENTS. (DAG)
